A workshop on resolving community and engineering disputes through alternative dispute resolution mechanisms
On Saturday, September 30, 2023, a workshop on resolving community and engineering disputes through alternative dispute resolution mechanisms was held at the Jerusalem Engineers Syndicate in coordination between the ACT for Conflict Resolution Foundation and the Engineers Syndicate, with the help of engineer Mudhar Al-Tari.
The ceremony was opened by Engineer Alaa Abbas, head of the Jerusalem branch, by welcoming the attendees and participants from the ACT Foundation.
Then, Engineer Ra'fat Zaytoun began the meeting with words of welcome and words of thanks to the Engineers Syndicate and the ACT Foundation for this useful and productive meeting for the general engineering community.
The meeting was divided into two parts: the first was face-to-face, in which Engineer Ihab Zahika spoke about engineering FIDIC contracts, their clauses and general structure, as well as the types of FIDIC contract books, the advantages of each type, and the history of those releases from the beginning to what they ended with in FIDIC 2017, especially the red book. Then, lawyer Ms. May Abu Ghazala spoke about mediation as a modern method of resolving disputes in terms of its procedures, foundations, and objectives, as well as its most important features in terms of neutrality, confidentiality, and voluntariness.
Dr. Lawyer Mahmoud Abu Sawi was the third speaker, and his valuable intervention was about arbitration, its difference from mediation on the one hand, and its intersection with it on the other.
After the break and hospitality, the second part of the meeting began via Zoom with the last speaker, Dr. Mohamed El-Shair from Egypt, who gave a valuable intervention on the Engineering Disputes Arbitration Board (DAAB) and the sequence of procedures it carries out after being appointed as a board to resolve disputes between the parties to the contract in case of occurrence. After that, the door to discussion was opened to the audience, which enriched the meeting with its interventions and inquiries.
In conclusion, Engineer Ra'fat Zaytoun, who moderated the meeting and the dialogue, thanked the participants, attendees, and the Engineers Syndicate for the success of this different and qualitative activity, hoping that the meetings will be renewed in the future, God willing.
