The thirteenth episode of the Mediation Forum titled: "Five Years After the Singapore Agreement: The Reality of Mediation in Palestine and the Arab World"
The thirteenth session of the Mediation Forum was held by ACT Conflict Resolution on Sunday, 11 June 2023, with the support of a Swasiya programme and in partnership with the Ministry of Justice, under Time to ADR in East Jerusalem project, titled:
Five Years After the Singapore Agreement: The Reality of Mediation in Palestine and the Arab World"
This meeting is part of the institution's efforts to spread the culture of mediation in Jerusalem and Palestine by opening up to the Arab world to publicize the principles of the mediation mechanism and distinguish it from other ADR methods such as arbitration, negotiation and other means of resolving disputes without recourse to the State judiciary. ACT hosted this meeting via Zoom, which lasted one hour and half, each of:
- Professor Fatima Ibrahim, a legislative reform expert, community advocate, mediator accredited by the Centre for Effective Dispute Resolution, Seder - London, and mediation instructor
- Dr. Iman Mansour, Executive Director at the Investor Dispute Resolution Center in Cairo. Mediator accredited by the Centre for Effective Dispute Resolution, Seder - London
With the support and presence of Adv. Mohammed Hadieh, Executive Director of ACT Conflict Resolution, a mediation instructor, researcher and member of the National Committee for the preparation of the Palestinian Convention Mediation Bill.
The meeting took the form of an interactive session and was moderated by Professor Fatin Ben-Amin of Tunisia, a lawyer at the Ta'kib Advocacy Office, and at the foundation of Al-Amin International Law Firm for Mediation and Arbitration LIAMA; Lawyer and mediation expert accredited by ACT Conflict Resolution.
The meeting dealt with several interlocutors and was answered by the guests of the meeting, centred on the presentation of the Singapore Convention and its historical background. The scope of its application also dealt with the areas excluded, the applicability of hybrid means, the reservations permitted to invoke the Settlement Convention... In addition to the force of the injunction, request for implementation of the Settlement Agreement, the reasons for rejection of the petition and protest, as well as the reality of mediation in the light of the existence of this Convention in the world, especially in the Arab States
The Forum was attended by more than 65 participants from the Forum's delegates. Their questions centred on the realities of mediation in the Arab world, which is still at a slow pace, considering that the culture of mediation does not spread in the absence of the adoption of its domestic mediation laws and has not adopted legislation establishing a legal framework governing it.
