Finalizing the introductory course to Contractor's dealership contracts as a part of The Project: Time to ADR in the City of Jerusalem

As part of the series of training courses announced through Time to ADR in Jerusalem Project, ACT Conflict Resolution held a specialized training course entitled: "Introductory Course to Contractor's dealership contracts", with 10 training hours spread across five meetings. It is a preliminary course for another session with the theme: "Practical use of FIDIC contracts."

The first training session was held on 17/05/2023 and lasted until 31/05/2023 for three weeks, during which Dr. Maryam al-Awwa highlighted the concept of the contract and the general legal rules contained in its composition, the health of its elements and the reasons for its invalidity at the first meeting.

At the second meeting, the trainees learned about the contractor's contract, its types and elements, how to implement it and what the law requires in this regard. Dr. Maryam also addressed the characteristics of the contractor's contract. She explained the role and legal responsibilities of the consultant, the nature of the relationship with the subcontractor, and the latter's rights vis-à-vis the owner and the contractor.

At the third meeting, the trainees learned about the contractor's obligations to complete and deliver the work, the loss of the work and the material provided, and the safety of the works and the decimal place, while simulating these obligations with reality and practical application.

Dr. Maryam devoted the fourth meeting to recognizing the employer's obligations in accordance with the law and the most important judicial rulings handed down by the Supreme Courts on this subject.

At the fifth and final meeting, she highlighted the issue of the extent to which the contractor's contract could be amended and the obligations contained therein waived and how it would expire, all in accordance with the laws in force in Palestine and comparative laws such as the Egyptian and Jordanian Civil Code.

We note that the ACT Conflict Resolution, with the support of an equal programme and in partnership with the Palestinian Ministry of Justice within the project to strengthen the role of alternative means of conflict resolution in Jerusalem, is organizing several training courses aimed at strengthening the role of alternative means of conflict resolution. This course was organized in a series of training courses on the theme "Practical use of FIDIC contracts."
