The ACT Foundation for Dispute Resolution held the sixth dialogue session of the Arbitration Forum, on Wednesday, 05/17/2023, with the support of the Sawasya Program and in partnership with the Ministry of Justice within the project to strengthen the role of alternative means of resolving disputes in Jerusalem under the title “Arbitration in Palestine between Legislation and Judiciary” in the belief Including the importance of highlighting issues related to arbitration as an alternative means of resolving disputes and developing and promoting the dissemination of the culture of arbitration among members of society.

The ACT Foundation hosted, through the arbitration forum via the Zoom application, for two hours, Judge Hazem Idkidek, Judge of the Supreme Court from Jerusalem, who previously presided over the positions of Secretary General of the Supreme Judicial Council, President of the Court of First Instance in Bethlehem and First Instance of Hebron, and President of the Customs Court, and Professor Nabil Azhiman from Jerusalem. He is an arbitrator, mediator, legal advisor, and a lecturer in the arbitration and mediation courses of the ACT Foundation for Dispute Resolution, in a dialogue session prepared by lawyer Heba Thouqan, in the presence of more than 37 participants from various Arab countries.

In this dialogue, several questions were answered, the most important of which are: clarifying the legal situation in Palestine, especially with regard to the Palestinian jurisdiction in the regions of the West Bank and Gaza Strip, in addition to knowing the legal situation in the occupied Jerusalem region, and the role of the Palestinian judiciary in the stages of the arbitration process has been identified And that is from the perspective of the legislation in force in Palestine and knowledge of the practical experiences of arbitration issues in occupied Jerusalem and what are the problems related to the mechanism of implementing arbitrators’ rulings in the two jurisdictions, in addition to knowing the importance of resorting to alternative means to resolve disputes in the West Bank, Gaza Strip and occupied Jerusalem, where everyone agrees on The importance of spreading cultural awareness on this subject through all available methods and means.

Many of the participants expressed their opinions and questions about the topic of the dialogue session by presenting their practical experiences, which led to enriching this dialogue session with many opinions that raised many important topics.

We note that the ACT Foundation for Dispute Resolution, with the support of the Sawasya Program and in partnership with the Palestinian Ministry of Justice, within the project to strengthen the role of alternative means of resolving disputes in Jerusalem, will work to organize dialogue sessions periodically through the Arbitration Forum to shed light on many issues and problems related to arbitration as an alternative means of resolving Disputes and in order to promote resorting to alternative means to resolve disputes and raise awareness about the culture of arbitration, especially in the occupied city of Jerusalem.
